TRUSTS AND HOLDOVER RELIEF

Would you like to gift some property to your children?

When looking at your estate planning, it may be worth considering some aspect of trust planning.

Some clients are looking at ways to pass the assets down to their children and grandchildren that may be pregnant with Capital Gains. If they were to directly gift these properties to the children from their estate, it will be a disposal of assets at full market value for capital gains tax (CGT) purposes.

Some clients could consider transferring some of their assets out of their estate using a UK Trust and utilising something called Holdover Relief.

Section 260 TCGA 1992 provides that capital gains tax need not be paid on non-business assets transferred into a UK resident trust as long as certain conditions are met.
